About these terms
These Terms of Service ("Terms") govern your use of the ChowBuy websites and apps (the "Service") provided by ChowBuy Technologies Ltd. By creating an account or placing an order you agree to these Terms and our Privacy Policy.
Eligibility and accounts
- You must be 18 or older and able to form a binding contract in Nigeria.
- Provide accurate information and keep your password and wallet PIN secure.
- You are responsible for activity on your account. Tell us immediately about unauthorised use.
- We may suspend or close accounts that breach these Terms or put others at risk.
How ordering works
ChowBuy is a marketplace. Restaurants, shops and pharmacies ("Partners") prepare and sell items, and independent riders deliver them. When you place an order you contract with the Partner for the goods and with ChowBuy for the delivery and platform services.
An order is confirmed when the Partner accepts it. Delivery times are estimates and may change with traffic, weather or demand.
Prices, fees and payment
- Item prices are set by Partners. Delivery, service fees and taxes are shown before you pay.
- Payments are in Nigerian Naira (₦) by card, bank transfer or ChowBuy Wallet.
- Promo codes and offers follow their stated rules and may be withdrawn if misused.
- Wallet balances are used only for purchases and transfers on ChowBuy and are not bank deposits.
Delivery
Please provide an accurate address and be reachable. If we cannot complete delivery because of an incorrect address or no response, the order may be cancelled without refund of the cost of prepared goods. Age-restricted or prescription items may require identification or documents at delivery.
Cancellations and refunds
- You can cancel before the Partner accepts your order for a full refund.
- After acceptance, cancellation may not be possible because preparation has started.
- If items are missing, wrong or unsafe, or your order is not delivered, report it within 24 hours via Report an Issue. After review we refund or credit the affected amount.
- Refunds go to your wallet or original payment method. Timing depends on your bank or card issuer.
Group orders and Office Mode
In group orders, the host and participants are responsible for their share according to the split mode chosen. In Office Mode, the company account holder controls allowances, budgets and approvals and is responsible for payments on that account.
Acceptable use
You agree not to:
- Use the Service for unlawful, fraudulent or abusive purposes.
- Harass or threaten riders, Partners or staff.
- Abuse promotions, create fake accounts or file false claims.
- Interfere with the Service or attempt unauthorised access.
- Reverse engineer or scrape the Service.
Food, health and allergens
Partners are responsible for the preparation, labelling and safety of their food. If you have allergies, tell the Partner through the order notes and contact them directly where possible. ChowBuy cannot guarantee that any item is free of allergens.
Intellectual property
The ChowBuy name, logo, app and content are owned by us or our licensors. You may use the Service for personal, non-commercial purposes only. Partner menus, photos and names belong to the relevant Partners.
Liability
We provide the Service with reasonable care. To the extent permitted by law, we are not liable for indirect or consequential losses, or for Partners' and riders' acts outside our control. Nothing in these Terms limits liability that cannot be limited under Nigerian law, including for death or personal injury caused by negligence or for fraud.
Disputes and governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. We encourage you to contact support first so we can resolve any dispute informally. If we cannot, the courts of Nigeria will have jurisdiction, subject to any rights you have under consumer protection law.
Changes and contact
